1. Who we are
This website is operated by BILOUD SRL (TopBlend) (referred to as “TopBlend”, “we”, “us”), registered with the Romanian Trade Registry (ONRC) under no. 2. Scope
These Terms govern your use of www.topblend.ro and the placement of orders for products offered by TopBlend. By using the website and/or placing an order, you confirm that you have read, understood and agree to these Terms.
3. Key definitions
• User/Customer – any person who visits the site, creates an account or places an order.
• Products – coffee, accessories and other goods listed on the site.
• Order – the request to purchase products placed through the checkout flow.
• Contract – the distance contract concluded between you and TopBlend upon our order confirmation.
4. Account and site use
Creating an account is optional but helps with tracking deliveries and returns. You are responsible for keeping your login details confidential and for the accuracy of the information provided.
5. Product information and prices
We make every effort to ensure that images, descriptions, origin/roast of coffee and stock levels are accurate. Minor differences in packaging/colour may occur and do not affect quality. Prices are in RON and include VAT unless stated otherwise. In the event of obvious pricing/display errors, we may cancel the order and refund any amounts paid.
6. Placing orders and contract formation
Standard flow: add to cart → checkout → choose shipping and payment → place order → automatic acknowledgment e‑mail → confirmation e‑mail (contract formation). If an order cannot be fulfilled (e.g., out of stock), we will contact you and promptly refund any amounts paid.
7. Payments
Payments may be made online through authorised processors (e.g., card, Shop Pay, Apple Pay, Google Pay where available) or cash-on-delivery if offered at checkout. For online payments, the transaction is processed securely by the payment processor; TopBlend does not store your full card data.
8. Invoicing
Invoices are issued electronically based on the billing details you provide. Please ensure they are accurate when placing the order.
9. Shipping
Available shipping options and costs are shown at checkout depending on your address and the carrier. Timeframes are indicative; you will receive tracking details.
10. Transfer of title and risk
Title transfers upon delivery/payment (according to your chosen payment method). Risk of loss/damage passes upon delivery to you or a person you designate.
11. Right of withdrawal (EU consumers)
You have the right to withdraw within 14 days from delivery. To exercise it: e‑mail us at https://topblend.ro/pages/contact and return the products without undue delay, within 14 days from your notice. For food products (coffee), returns are accepted only for sealed, unopened items in original packaging. Opened/partially consumed products are not returnable for health/hygiene reasons. Return shipping costs are borne by you unless we state otherwise.
12. Returns and refunds
Once we receive an eligible return, we will refund the product value via the original payment method within 14 days. We may deduct amounts for diminished value caused by improper handling.
13. Legal guarantee
Products are covered by the statutory conformity guarantee. For issues, contact us at https://topblend.ro/pages/contact with your order number, description and photos.
14. Promotions, coupons, gift cards
Specific rules (period, eligibility, combination) are communicated for each campaign. Gift cards can be used on the site and cannot be exchanged for cash.
15. Subscriptions (where available)
If you activate recurring deliveries/subscriptions, we will display frequency, price and the cancellation mechanism in your account/e‑mail. You can cancel any time before the indicated renewal date.
16. User‑generated content (reviews)
You may post reviews responsibly. Content that is defamatory, obscene, discriminatory, promotional/advertising or infringing others’ rights is not allowed. We may moderate/remove infringing content.
17. Intellectual property
All materials on the site (texts, graphics, logos, photos, videos, trademarks) are protected by IP laws. Use without prior consent is prohibited. Third‑party marks remain the property of their owners.
18. Third parties and services
The site uses online platform and third‑party services (payment processors, carriers, analytics tools, etc.). Each may have its own terms and policies; please review them where indicated. We are not responsible for third‑party websites we link to.
19. Liability
We are not liable for indirect losses (e.g., lost profits, opportunities) that are not a foreseeable consequence of our breach. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
20. Force majeure
We are not liable for failure to perform due to events beyond our reasonable control (e.g., natural disasters, conflict, network outages, acts of authorities).
21. Data protection and cookies
Your personal data is processed according to our Privacy Policy and Cookie Policy available on the site. Please review them for details (legal bases, retention, GDPR rights, recipients).
22. Governing law and disputes
These Terms are governed by Romanian law and EU legislation. Disputes will be settled amicably where possible, otherwise by the competent Romanian courts. Consumers may also use Alternative Dispute Resolution (ADR) or the EU ODR platform.
23. Changes to the Terms
We may update these Terms periodically. The version in force is the one displayed on the site at the time of order. The last update date appears at the top of the page.
